ORDER CANCELLATION POLICY AND TERMS OF SALE
I submitted my order, What’s Next?
Due to our customer service commitment to process orders quickly, there is a short period of time in which you may cancel your order. Once an order is submitted by a customer, the payment is verified through the secure payment system and the order is sent electronically to the warehouse for Fulfillment within 1 HOUR of your order time as noted on your electronic confirmation invoice sent to you via email. Fulfillment is a warehouse process which consists of picking your order items and packing them safely and professionally into an appropriate shipping container / package and then the order is sent to Shipping. Shipping is a warehouse process which consists of Verifying the address, assigning appropriate labels the container / package, weighting the container / package and loading the container / package on a trailer for pick up each day. Once your container / package is loaded on the Out Going Trailer, you will receive an electronic verification of shipping and a tracking # from shipping company and an additional verification of shipping from onlinefireworks.com. If you do not get a tracking # for some reason, please feel free to contact us immediately at boomtozoom@aol.com.
Please Note: Out Going Trailer pick up is at 9:00 AM Monday THRU Friday at boomtownfireworks.com warehouse distribution center. If you order after 9:00 AM your package will be on the next day’s trailer, if you order on Friday after 9:00 AM your package will be on the Monday AM out going trailer.
Fulfillment and Shipping work hours are from 9:00 AM to 5:00 PM and are 5 days a week unless otherwise noted due to holidays, etc.
Can I Cancel My Order? Are there cancellation Fees?
Please review the 3 circumstances below for more details.
1. You may choose to cancel your order WITHOUT CANCELLATION FEES as long as the order has not yet been sent to our warehouse for Fulfillment and Shipping. *****THUS, YOU MUST EMAIL YOUR ORDER to BOOMTO ZOOM@AOL.COM AND CANCEL YOUR ORDER WITHIN 1 HOUR OF YOUR ORIGINAL ORDER SUBMISSION TIME TO PREVENT THE WAREHOUSE FULFILLMENT AND SHIPPING PROCESS AS NOTED ABOVE.
2. If you request to cancel your order AFTER (1 HOUR of original order time) your order was already sent electronically to warehouse Fulfillment and Shipping. THUS, THE WAREHOUSE FULFILLMENT AND SHIPPING PROCESS HAS BEGUN OR HAS BEEN COMPLETED. Due to the time to pick order items from stock, staff time and packing supplies used in the process, THUS, CANCELLATIONS AFTER 1 HOUR WILL BE CHARGED A 25% TOTAL PRODUCT ORDER RESTOCKING FEE AND A MINIMUM PACKING SUPPLY CHARGE OF $10.00 PER ORDER PENDING SIZE OF ORDER.
Please Note: The cancellation must be done prior to loading your final container / package on the Out Going Trailer or there are other cancellation fees associated as noted below.
3. If you request to cancel your order AFTER your container / package is loaded on the Out Going Trailer AS EVIDENCE BY, you will receive an electronic verification of shipping and a tracking # from the shipping company and an additional confirmation from Boomtownfireworks.com. (We are not responsible for shipping company errors or malfunctions that prevent you from getting accurate or timely notification of your shipment, if this is the case all onlinefireworks.com computer files will act as the final authority, also, onlinefireworks.com is not responsible for internal errors that prevent the additional timely notification of your shipment).
THUS, YOUR ORDER IS NOW COMPLETE AND PACKED ON AN OUT GOING TRAILER WITH HUNDREDS OF PACKAGES, IT IS TIME CONSUMING AND UNSAFE TO BE REMOVED AND SORT ALL THE PACKAGES, PER POLICY, ONCE A PACKAGE IN LOADED ON THE OUT GOING TRAILER IT IS CONSIDERED SHIPPED AND NOT PERMITTED TO BE REMOVED BY BOOMTOWNFIREWORKS.COM STAFF EVEN IF THE ORDER IS CANCELLED.
THUS, A 25% TOTAL PRODUCT ORDER RESTOCKING FEE AND A MINIMUM PACKING SUPPLY CHARGE OF $10.00 PER ORDER PENDING SIZE OF ORDER.
IN ADDITION, THESE ADDITIONAL CANCELLATION FEES APPLY: A UPS CHARGE OF $30.00 INTERCEPT FEE AS UPS WILL NEED TO REMOVE PACKAGE FROM TRAILER AT TERMINAL, SINCE THE PACKAGE WAS LOADED IT IS CONSIDERED SHIPPED BY THE SHIPPING COMPANY AND ORIGINAL SHIPPING CHARGES WILL APPLY PLUS THE SHIPPING COMPANY CHARGES THE ORIGINAL SHIPPING CHARGES TO RETURN THE PACKAGE TO US AT BOOMTOWNFIREWORKS.COM.
I received an email stating my order has been canceled? Are there fees? Please explain.
If you received this is mail it is for one of 2 reasons explained below.
1. Items unable to ship UPS ground to your state. Please contact us or check your state laws posted on our website. Only Novelty items may ship UPS ground all other firework items must ship truck freight additional charges apply, must be picked up at our store or delivered to your home or office in specific Indiana counties only.
2. Items unable to ship due to your state law. Again, please contact us or check your state laws posted on our website. Only Novelty items may ship UPS ground all other firework items must ship truck freight additional charges apply, must be picked up at our store or delivered to your home or office in specific Indiana counties only.
Cancel notice via email fee and non fee situations
1. Some items ordered are unable to ship UPS ground and / or unable to ship due to state law - Per policy we will automatically substitute an item of our choice of = or greater value for all items unable to ship. No fees
2. All items ordered are unable to ship UPS ground and / or unable to ship due to state law - Fees Apply as noted.
a. If your Order total is under $35.00 we will automatically substitute all items unable to ship via UPS ground and / or to your state with products of our choice of = or greater value, if you order contains all items not able to ship we will substitute the entire order with prodcuts of our choice. No refund, no returns. No Fees
b. If your Order total is over $35.00 we will charge a $10.00 FEE for cancellation of the order and to process all the paperwork, credit card fees, and labor. NO refunds, non refundable.
*****This cancellation policy is clearly stated on the website and must be acknowledged and approved with a check in the box at checkout that you understand, acknowledge and agree to the policy and you authorize www.boomtownfireworks.com to bill your payment source the additional cancellation funds if they are needed to fulfill the cancellation.*****
Cancellation Policy
All orders that are cancelled will be credited in the original form of payment used when the order was placed.
Orders with Coupons: If you used a coupon on your order, you will be credited for the entire order minus the coupon amount. Please note that coupons are treated as discounts and will not be recreated or reissued.
For orders with multiple items where only some items are cancelled, your order total will be recalculated to determine if the coupon still applies. For example, some coupons require a minimum purchase amount or are coupons for specific products only.
Orders with In-store Credit
If you placed an order using in-store credit, the portion of the order paid with in-store credit will be refunded as in-store credit after all other payment methods have been credited.
Can I Change My Order?
Unfortunately, we are unable to make any changes to an existing order. There is a short period of time in which an order may be cancelled. If you choose to cancel, we encourage you to replace the order or obtain a store credit for later use.
Usage by children under 18
We cannot prohibit minors from visiting the Site. We must rely on parents, guardians and those responsible for supervising children under 18 to decide which materials are appropriate for such children to view and/or purchase.
We require that all purchases be made either (i) by individuals 18 years of age or older, or (ii) by minors with the permission of their parent or guardian for such minors to purchase items on the Site and for the collection by us of certain information in accordance with the terms of our privacy policy. EACH TIME YOU PURCHASE A PRODUCT AT Onlinefireworks.com, YOU ARE REPRESENTING TO boomtownfireworks.com THAT YOU ARE EITHER AN INDIVIDUAL 18 YEARS OF AGE OR OLDER, AND FOR US TO COLLECT CERTAIN INFORMATION ABOUT YOU IN ACCORDANCE WITH THE TERMS OF OUR PRIVACY POLICY.
Random AGE Verification Process
We reserve the right at times to randomly check the age of the person/s making the order. If your order is randomly selected you will be notified via phone or email that your order is "Pending Age Verification $25.00 fee +). You will not be charged the fee of $25.00 fee +(additonal 25% restocking fee on total order total as your order has been pulled and packed, plus $20.00 supply fee for packing materials and labor charges). Total Minimum charge is $45.00 plus the 25% or order total restocking fee. Again, this fee is only if you do not respond to our AGE verification process via phone or email. We will attempt 3 times in both manners, if unable to verify, we will cancel order and apply charges. If your order was not enough to cover the applicable charges, you authorize and approve boomtownfireworks.com to charge the additional fees to your payment source.
Parent / Guardian Notice of Minors
If your minor uses your payment system to make an unauthorized, illegal purchase as you must be 18 years of age, the minors parents / guardian is still responsible for the applicable fees. All contested court, law fees shall be paid by the contesting party in the State of Indiana.
*****If the card was used without your permission / stolen, we reserve the right to press criminal charges against the person placing the order to recover our costs associated with the transaction in the court of Law in Indiana.
Product Substitutions / Items not legal in my state / not legal to ship
We Reserve the right at anytime to substitute any item due to unavailable, out of stock, or low quantity with an item of equal or greater value.
If you Order an item that is not LEGAL to SHIP to your STATE or an ITEM that is NOT LEGAL to SHIP in the manner paid for by you, WE WILL SUBSTITUTE THE ITEM FOR AN ITEM of equal or greater value that is LEGAL TO SHIP without contacting you the consumer. Some items are able to ship to your state but are illegal for use pending local laws, please check local as well as state laws before use as, again the item may be legal to ship as a de-regulated novelty, may be legally used in your state but your local ordinance may ban the use. Boomtownfireworks.com is not responsible for misuse, or consumer failure to follow all local and state laws.
All sales are Final, no refunds or exchanges once your product is shipped for the safety of all consumers. (This policy is also in effect for all safe and sane items aka Novelty items by our Novelty division)

PS: We will not accept return of goods unless you have a store receipt and the item
along with it’s packaging and a plausible safety reason for the return of the item. We have the right to replace the item with an identical one or something of like value but are under no legal obligation to accept it or make an exchange except to keep you
happy and continuing to shop with our store in the future. So for the sake of goodwill if the item’s value is under $50 dollars we are willing to listen and make a reasonable exchange.
WE WILL NOT REFUND CASH OR CREDIT MERCHANT CARDS – ONLY EXCHANGE WITH RECEIPT AND A SAFETY MALFUNCTION ARE GROUNDS FOR REPLACEMENT OF GOODS.
